A mixed-use development comprising of commercial, industrial, multifamily residential, and civic space on lands located on the northeast and southeast corners of the intersection of Lehigh Station Road and East River Road, including parcels with Tax Account Nos. 174.02-1-43, 174.04-1-21.1, and 174.04-1-21.2. Proposed modification to now include attached single family residential, and to allow the construction of +/- 236 single family attached dwellings.

December 7, 2020 Town Board Workshop Presentation

Jess Sudol, P.E., Passero Associates / Tim Harris, P.E., Passero Associates / Tom George, Commercial Street Partners gave a presentation to the Town Board regarding the proposed Lehigh Mixed Use Development project located at the far western portion of Lehigh Station Road both on the north and south sides of the road, across from the recent student housing projects of The Lodge and the Hill as well as Rainaldi's redevelopment of the former Kodak facility currently known as Riverwood Tech Park.

February 10, 2021 Special Use Permit Public Hearing

A meeting was held on Wednesday, February 10, 2021 at 5:30 p.m., before the Henrietta Town Board to hear all persons with regards to the following Applications for a Special Use Permit:

Application No. 2020-029: Lehigh Mixed Use Development (Commercial Street Partners) – 84 Lehigh Station Road, to construct +/-350 multifamily housing units, in an Industrial Zoned District with a Mixed Use Employment Center Overlay District (MUEC), Tax Account No. 174.02-1-43, or as more particularly described in plans on file in the Town Clerk’s Office and posted online.  Whereas the Special Use Permit is solely to authorize the multifamily housing portion of the project, the developer is also proposing Commercial and Industrial development at 85 Lehigh Station Road (Tax ID No. 174.04-1-21.1) and 135 Lehigh Station Road (Tax ID No. 174.04-1-21.2).

The public hearing was kept open.

March 10, 2021 Special Use Permit Public Hearing

A meeting was held on Wednesday, March 10, 2021 at 5:30 p.m., before the Henrietta Town Board to hear all persons with regards to the following Applications for a Special Use Permit:

Application No. 2021-017: Lehigh Mixed Use Development (Commercial Street Partners) – 84/85/135 Lehigh Station Road, to allow construction of a mixed-use development on the parcels including commercial, industrial, multifamily residential, and civic space components, in an Industrial Zoned District with a Mixed-Use Employment Center Overlay District (MUEC), Tax Account Nos. 174.02-1-43, 174.04-1-21.1, 174.04-1-21.2, or as more particularly described in plans on file in the Town Clerk’s Office and posted online.  (Associated Application: SP2020-029 for the multifamily residential component.)

The public hearing was closed.

March 24, 2021 Special Use Permit Approval

APPROVED - The Town Board made the SEQR Determination and approved the Special Use Permit Applications by the following resolutions:

  • Resolution #6-82/2021 Accepting SEQR Determination and issuing a Negative Declaration for the Lehigh Mixed Use Development at the corner of East River Road and Lehigh Station Road.
  • Resolution #6-83/2021 Approving Special Use Permit No. 2021-017 for the Lehigh Mixed Use Development submitted by Commercial Street Partners to allow the construction of a mixed-use development.
  • Resolution #6-84/2021 Approving Special Use Permit No. 2020-029 for the Lehigh Mixed Use Development submitted by Commercial Street Partners to allow the construction of multifamily housing.

May 12, 2021 Special Use Permit Public Hearing

A meeting was held on Wednesday, May 12, 2021 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following Applications for a Special Use Permit:

Application No. 2021-036: Commercial Street Partners (Lehigh Mixed Use Development Multifamily) – 84 Lehigh Station Road, to construct 4 multifamily buildings with a building height of 55-feet whereas Town Code only permits a height of 40-feet, in an Industrial Zoned District with a Mixed Use Employment Center Overlay District (MUEC), Tax Account No. 174.02-1-43, or as more particularly described in plans on file in the Town Clerk’s Office and posted online.  

APPROVED - The public hearing was closed and the Special Use Permit application was approved.

May 18, 2021 Planning Board - Site Plan Approval - Apartments

For final site plan approval of a +/- 352 unit complex with apartments and townhomes on 57.533 acres located at 84 Lehigh Station Road in an Industrial Zoned District with a Mixed Use Employment Center Overlay. Tax Account No. 174.02-1-43.

APPROVED - This Planning Board application was approved. 

August 17, 2021 Planning Board - Site Plan Re-Approval - Apartments

Lehigh Mixed Use Development Apartments (Lot 1) – For site plan approval of a 196 residential unit complex on 28.175 acres currently located at 84 Lehigh Station Road in an Industrial Zoned District with a Mixed Use Employment Overlay District.  Part of Tax Account No. 174.02-1-43.

Lehigh Mixed Use Development Apartments (Lot 2) – For site plan approval of a 156 residential unit complex on 29.358 acres currently located at 84 Lehigh Station Road in an Industrial Zoned District with a Mixed Use Employment Overlay District.  Part of Tax Account No. 174.02-1-43.

[Parcel is pending re-subdivision and the project is being re-reviewed due to changes to the site plan as part of the re-subdivision.]

Application Nos. 2023-012/013: East River Henrietta, LLC (Formerly known as Lehigh Mixed-Use) – 84, 85, and 135 Lehigh Station Road, in an Industrial Zoned District with a Mixed-Use Employment Center Overlay District (MUEC), Tax Account Nos. 174.02-1-43, 174.04-1-21.1, 174.04-1-21.2. 

  • 2023-012: to modify a previously approved mixed-use development (SP2027-017) comprised of commercial, industrial, multifamily residential, and civic space to now include attached single family residential.
  • 2023-013: to construct +/- 236 single family attached dwellings

Public Hearing was held open to be continued at a the May 10, 2023 Town Board meeting.
