Wednesday, February 8, 2023 Special Use Permit Public Hearing
A meeting will be held on Wednesday, February 8, 2023 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following Application for a Special Use Permit:
Application No. 2023-002: Shake Shack by 911 Jefferson Road, LLC – 245 Clay Road (known as 911 Jefferson Road), to demolish the former Denny’s restaurant and construct and operate a new restaurant building with sit down and take out meal service, outdoor seating, and a drive-thru, in an Industrial Zoned District, Tax Account No. 162.09-1-4, or as more particularly described in plans on file in the Town Clerk’s Office. Planned hours of operation are seven days a week from 11:00 a.m. to 9:00 p.m.
APPROVED - The public hearing was closed and the application was approved by Resolution, which is attached below in Files.

For final site plan approval of a new +/- 4,588 S.F. restaurant with a drive-thru & outdoor seating located at 245 Clay Road (known as 911 Jefferson Road) in an Industrial Zoned District. Tax Account No. 162.09-1-4. (SEQR)

Wednesday, April 17, 2024 Special Use Permit Public Hearing
A meeting will be held on Wednesday, April 17, 2024 at 6:00 p.m., before the Henrietta Town Board to hear all persons with regards to the following Application for a Special Use Permit:
Application No. 2024-013: Shake Shack by 911 Jefferson Road, LLC – 245 Clay Road (known as 911 Jefferson Road), to modify the previously approved Special Use Permit Application (No. 2023-002 to demolish the former Denny’s restaurant and construct and operate a new restaurant building with sit down and take out meal service, outdoor seating, and a drive-thru) to now also allow the sale of alcohol and to have bands, DJs, or similar loud entertainment, in an Industrial Zoned District, Tax Account No. 162.09-1-4, or as more particularly described in plans on file in the Town Clerk’s Office. Planned hours of operation are seven days a week from 11:00 a.m. to 11:00 p.m.
APPROVED - The public hearing was closed and the application was approved. The Special Use Permit approval resolution is attached in the files below.
